SMS Terms of Service
Effective May 1, 2026
These SMS Terms of Service (the "Terms") govern Fischer Theatre's text messaging program (the "Program"). The Program is operated on behalf of Fischer Theatre by The Regulars Circle LLC. By signing up, you agree to these Terms and to our Privacy Policy.
1. Program Description
The Fischer Theatre SMS Program delivers recurring text messages to subscribers about Fischer Theatre programming, including:
- Show announcements when new performances go on sale
- Ticket deals and promotional codes
- Member presales and early-access opportunities
- Day-of show reminders for ticketed contacts
- Fundraising and donation appeals
- Venue rental information
2. How to Sign Up
You can join the Program by:
- Submitting the form on our SMS sign-up page
- Texting our keyword to our short code or 10-digit number (as displayed on our signage and marketing materials)
- Providing your number with consent through staff intake at the box office
All sign-ups go through a confirmation step (you'll receive a text asking you to reply YES) before you start receiving Program messages.
3. Message Frequency
The Program sends recurring text messages at a frequency of approximately 4 to 8 messages per month, depending on the package the venue selects and the programming calendar. Frequency may vary based on shows, special events, and seasonal cadence, but we will not materially exceed our published frequency range without notifying you in advance.
4. Cost & Fees
The Fischer Theatre Program itself is free to join. However, message and data rates may apply depending on your wireless plan. Check with your mobile carrier for specifics.

6. How to Opt Out (STOP)
You can opt out of the Program at any time. To opt out, reply with any of the following keywords to any message from us:
- STOP
- UNSUBSCRIBE
- CANCEL
- END
- QUIT
Once you opt out, you'll receive a single confirmation message and then no further messages from the Program. To opt out by other means, email info@fischertheatre.com with the phone number to remove.
7. How to Get Help (HELP)
For help, reply HELP to any message from us. You'll receive a response with our contact information and a brief description of the Program. You can also email info@fischertheatre.com or call the Fischer Theatre box office during regular business hours.
8. Re-Enrolling After Opting Out
If you've opted out and want to receive messages again, you may re-enroll at any time by signing up on our sign-up page, texting our keyword, or speaking with staff. You'll go through the same confirmation step as a new subscriber.
9. Eligibility
You must be 18 years of age or older to sign up for the Program. By enrolling, you certify that the mobile number you provide is yours, that you're authorized to receive messages on it, and that you agree to these Terms.
10. Supported Carriers
The Program is available on most major U.S. wireless carriers, including AT&T, T-Mobile (and its associated brands), Verizon, U.S. Cellular, and other CTIA-participating carriers. Some smaller or regional carriers may not be supported.
11. Privacy & Mobile Information
Your mobile number and SMS-program data are handled in accordance with our Privacy Policy.
The only third parties who handle your mobile information do so to deliver the Program on our behalf (our messaging platform, the U.S. Campaign Registry, and your carrier). See the Privacy Policy for full details.
12. CTIA & TCPA Compliance
The Fischer Theatre Program operates in accordance with the CTIA Short Code Monitoring Handbook, Messaging Principles & Best Practices, and the Telephone Consumer Protection Act (TCPA). All messages are sent only to subscribers who have provided express written consent through one of the sign-up methods above. Consent is not a condition of any purchase.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by text message in advance. Continued use of the Program after changes take effect constitutes acceptance of the updated Terms.
14. Disclaimer of Warranties
The Program is provided "as is." Fischer Theatre does not warrant that messages will be delivered without delay or interruption, or that the Program will be free of errors. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
15. Limitation of Liability
To the fullest extent permitted by law, Fischer Theatre, The Regulars Circle LLC, and our service providers will not be liable for any damages arising out of the Program, including missed messages, message delivery errors, or carrier-related issues.
16. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law principles. Any dispute arising out of these Terms or the Program will be resolved in the state or federal courts located in Vermilion County, Illinois.
